1 Scope

 Klas Amsterdam, located at Industrieweg 20A - 1.04A, 1512 ND Wormerveer, operates the website www.klasamsterdam.com and its related mobile apps (collectively, the “Site”). We (“Klas Amsterdam,” "klasamsterdam.com," "us," "we," and "our") act as the seller and your contractual partner for any transactions made through the Site. By accessing and using the Site, you (“user,” “buyer,” “customer”) agree to these Terms of Service (“Terms”) and the overall Agreement (see Section 2). Please read them carefully. All products, services, and information displayed by Klas Amsterdam serve as an “invitation to offer.” Your purchase order represents an “offer,” subject to these Terms. Klas Amsterdam reserves the right to accept or decline your offer at any time, for any reason.

2 Definitions

"Agreement" refers to these Terms, the Privacy Policy, the Warranty and Returns Agreement, and all relevant documents (e.g., Shipping Information), including any future amendments.
"Cart" is defined in Section 4.2.
"EEA" stands for the European Economic Area.
"EU" stands for the European Union.
"Klas Amsterdam," "klasamsterdam.com," "us," "we," and "our" refer to Klas Amsterdam and its affiliates, which facilitate purchases on the Site.
"Order Confirmation" is defined in Section 4.5.
"Payment Information" is defined in Section 4.3.
"Product" or "products" encompass all goods, merchandise, services, and offers displayed on the Site, along with relevant descriptions, warranties, and delivery details.
"Site" refers to www.klasamsterdam.com and its related mobile apps.
"Submissions" is defined in Section 9.4.
"Terms" refers to these Terms of Service, which are an integral part of the Agreement.
"Vendor," "seller," or "affiliate" describes any individual or entity offering products for purchase on the Site.

3 Electronic Communication

3.1 By visiting our Site or sending emails to Klas Amsterdam, you consent to electronic communication with us. This means you agree to receive messages from Klas Amsterdam via email or within the Site, allowing our representatives to contact you when necessary.

3.2 When purchasing products from our Site, you explicitly acknowledge and agree to be bound by the Agreement in effect at the time of your order. This applies whether or not you have registered an account with Klas Amsterdam.

3.3 You may only purchase from our Site if you comply with all applicable laws and agree to this Agreement. Additionally, we encourage you to review our Privacy Policy to understand how we collect, store, and protect your personal data, as well as our Warranty and Returns Agreement for details on your consumer rights.

4 Formation of Contract and Order Process

4.1 The information displayed on our Site serves as an invitation to make an offer rather than a legally binding offer to sell products. When you place an order, you submit an offer to purchase the selected product(s) from us.

4.2 To purchase products, add them to your digital shopping cart ("Cart"). Follow the checkout process, providing or verifying the required details at each step. Before completing the payment, you may modify your order details and may be asked to log in or register, enter a shipping address, and select a payment method and delivery option.

4.3 We accept the payment methods listed on our payment information page ("Payment Information"). While we do not charge additional fees for payment processing, you are responsible for any transaction costs imposed by your payment provider. Some payment methods may require additional authentication. We reserve the right to decline certain payment methods for specific orders.

4.4 After selecting a payment method and entering the required details, you can place your order by clicking the “Buy Now” button. This action submits a binding offer to purchase the product(s) in your Cart. Registered users can view their order history in the "My Account" section of the Site. If you identify an error in your order after payment, please contact us immediately to correct it.

4.5 Upon receiving your order, we will send an email confirmation ("Order Confirmation") to the email address provided at checkout. This email acknowledges receipt of your order but does not confirm acceptance of your offer.

4.6 Klas Amsterdam reserves the right to reject or modify any order, even if payment has been processed. If your order is declined, we will notify you via email. If payment has already been made, we will issue a refund for the corresponding amount.

Your order is officially accepted, and the purchase contract is finalized when we dispatch the product(s) to you. A shipping confirmation email will be sent to the email address provided at checkout. The terms of this Agreement apply to each completed purchase contract. 

5 Promotional Vouchers and Redemption

5.1 Promotional vouchers are issued during advertising campaigns and cannot be purchased. They are valid for a specific period as stated in the campaign.

5.2 These vouchers can be redeemed once per order within the specified period. Some items may be excluded from the promotion, and they cannot be used to purchase gift vouchers. A minimum order value may apply.

5.3 If you return all or part of an order, the promotional voucher will not be refunded.

5.4 Vouchers must be applied before completing the order process and cannot be added afterward. They are non-transferable and, unless otherwise agreed, cannot be combined with other vouchers.

5.5 If you used a promotional voucher and later return items, reducing the total order value below the minimum required for the voucher, we reserve the right to charge the original price for the retained product(s).

6 Product Availability and Description

6.1 We strive to provide accurate and up-to-date information on product availability, size, color, type, stock quantity, and descriptions. However, occasional errors, inaccuracies, or omissions may occur. We reserve the right to correct these at any time without prior notice, including after an order has been placed. Product details on the Site are for informational purposes only—please read all labels, warnings, and instructions before use.

6.2 The colors of products displayed on the Site may vary depending on your screen settings. We cannot guarantee that the colors you see will be an exact match to the actual product.

6.3 If a product you ordered is unavailable, we will notify you via email with an estimated restock date, if applicable. Please note that some items may not return in stock, and restock dates are subject to change. If your order cannot be fulfilled, you may cancel and receive a full refund if your payment has already been processed.

7 Delivery; Title and Risk of Loss

7.1 Unless otherwise agreed, orders will be shipped to the delivery address provided by you. Please refer to our Shipping Information for details on shipping costs, destinations, and estimated delivery times. We strive to deliver your order by the estimated date stated in your shipping confirmation email (see Section 4.7) or, if no date is provided, within 30 days from the shipping confirmation. If delivery is delayed for reasons within our control, we will keep you informed. If your order is not delivered within 30 days, you have the right to cancel and receive a full refund.

7.2 If you are a consumer residing in the EEA, the risk of loss or damage to the products transfers to you upon delivery. If you reside outside the EEA, this risk transfers to you upon dispatch to the shipping carrier.

7.3 Klas Amsterdam retains ownership of all ordered products until full payment has been received.

8 Product Pricing and Delivery Charges

8.1 Product prices are those listed on the Site at the time you place your order. We take all reasonable steps to ensure accurate pricing. However, prices may change over time, but any changes will not affect orders already placed. Prices include VAT (where applicable), but if VAT rates change before delivery, the adjusted rate will apply unless you have already paid in full.

8.2 Delivery charges are not included in the product price and will be shown at checkout before you confirm your order. For more details, please refer to our Shipping Information page. The total order cost includes both the product price and applicable delivery fees.

8.3 While we strive for accuracy, pricing errors may occasionally occur. If a product you ordered has an incorrect price, we will notify you and provide the option to proceed with the correct price or cancel the order. If we cannot reach you, the order will be automatically canceled, and you will be informed in writing. If a pricing error is obvious and should have been reasonably recognized, we reserve the right to cancel the order and notify you immediately.

9 Account Creation and Termination

By creating an account on our Site, you confirm that all provided information is accurate and truthful. We reserve the right to deny access, terminate accounts, or cancel agreements at any time, without prior notice, if we determine that:
• False or misleading information was provided.
• Any terms of this Agreement have been violated or abused.
• There is a breach of applicable laws.

10 Intellectual Property Rights

10.1 All intellectual property rights, including trademarks and copyrights, related to the items on the Site, belong to Klas Amsterdam and/or its subsidiaries or licensors. The content of the Site (including logos, design, graphics, and other materials) may not be used, copied, stored, or distributed in any way, without the explicit written consent and/or license from Klas Amsterdam.

10.2 Klas Amsterdam grants users a limited license to access the Site, but this does not include rights to download (except for page caching) or modify any part of the Site unless express written consent is provided. This license excludes any commercial use, resale, data collection, or extraction from the Site, as well as any reproduction or use of the Site for commercial or non-commercial purposes without prior written consent from Klas Amsterdam. You may not frame or use any of Klas Amsterdam’s trademarks or proprietary information without express written consent.

10.3 While we expect others to respect our intellectual property rights, we also respect the intellectual property rights of others. If you believe material on the Site infringes upon your intellectual property rights, please email us at info@klasamsterdam.com.

11 Warranty and Returns; Right of Withdrawal

11.1 If you are a consumer residing in the EEA, your right of withdrawal, warranty claims, and returns will be governed by the statutory provisions applicable in your jurisdiction.

11.2 If you are a consumer residing outside the EEA, the applicable mandatory local consumer protection laws will govern your right of withdrawal, warranty claims, and returns.

11.3 For further details regarding sections 11.1 and 11.2, please refer to our Warranty and Returns Agreement, which forms part of this Agreement.

12 Limitation of Liability

12.1 Subject to any applicable mandatory statutory provisions, including but not limited to the consumer rights outlined in our Warranty and Returns Agreement, and provisions under EU Directive 85/374/EC or relevant national laws regarding liability for defective products, all content displayed on the Site is provided without any guarantees, conditions, or warranties concerning its accuracy.

12.2 Unless expressly stated otherwise, and to the fullest extent permitted by law, Klas Amsterdam and its suppliers, content providers, and advertisers explicitly exclude all conditions, warranties, and other terms that may otherwise be implied by statute, common law, or other legal provisions, and shall not be liable for any damages.

12.3 If you are a consumer residing in Germany, clause 12.2 will read as follows: Unless expressly stated otherwise, and to the fullest extent permitted by law, Klas Amsterdam and its suppliers, content providers, and advertisers explicitly exclude all conditions, warranties, and other terms that may otherwise be implied by statute, common law, or other legal provisions, and shall not be liable for any damages. However, this does not include claims for damages arising from injury to life, body, health, or from the breach of essential contractual obligations. Furthermore, liability for other damages resulting from an intentional or grossly negligent breach of duty by Klas Amsterdam, its legal representatives, employees, or vicarious agents is excluded. Essential contractual obligations are those necessary to fulfill the contract’s purpose. In the event of a breach of such obligations, Klas Amsterdam will only be liable for foreseeable damage typical for the type of contract, caused by simple negligence, unless the claims are based on injury to life, body, or health.

12.4 The limitation of liability will also apply to our legal representatives, employees, and vicarious agents in the event that claims are asserted directly against them.

13 Linking to This Site

You may link to our Site, provided that you do so in a fair and legal manner, without damaging our reputation or taking advantage of it. However, you must not establish a link in a way that falsely suggests any form of association, approval, or endorsement by us.

You are not permitted to establish a link from any website that is not owned by you. The Site, including its content, must not be framed on any other website or app, nor may you create a link to any part of this Site or its linked pages other than the main page.

We reserve the right to withdraw linking permission at any time without notice.

14 Indemnity

14.1 You agree to indemnify, defend, and hold harmless Klas Amsterdam, its affiliates, suppliers, licensors, partners, and its directors, officers, employees, consultants, and agents, to the fullest extent permitted by law, from any and all third-party claims, liabilities, damages, and/or costs (including but not limited to legal fees) arising from or related to your use of the Site or any breach of this Agreement.

14.2 We will notify you promptly of any such claims and will provide you (at your expense) with reasonable assistance in defending the claim. We reserve the right, without affecting your indemnification obligations, to assume the exclusive defense of any claims directed at us. In such cases, you will provide all necessary assistance, documents, declarations, or other support reasonably required by us.

15 Variation

Klas Amsterdam reserves the right, at its sole discretion, to amend, remove, or vary the services and/or any page of the Site at any time and without prior notice.

16 Severability

If any part of these Terms or the entire Agreement is deemed unenforceable (including any provision that limits our liability to you), the enforceability of the remaining parts of the Terms or Agreement will not be affected. The remaining provisions will continue in full force and effect. Where possible, any clause or sub-clause, or part thereof, can be severed to ensure that the remaining part remains valid, and the clause will be interpreted accordingly. Alternatively, you agree that the clause will be modified and interpreted in a manner that closely aligns with its original intent, as permitted by law.

17 Complaints; Dispute Resolution

17.1 We have a complaints handling procedure in place to address and resolve disputes as they arise. If you have any complaints or feedback, please let us know, and we will do our best to assist you.

17.2 For residents of the EEA, the European Commission offers an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. Please note that we are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

18 No Waiver

No waiver of any term of this Agreement shall be considered a further or continuing waiver of that term or any other term. Our failure to assert any right or provision under this Agreement does not constitute a waiver of that right or provision.

19 Assignment

You are not permitted to assign or transfer these Terms or the Agreement (or any of your rights or obligations under these Terms or the Agreement) without obtaining our prior written consent. Any attempt to assign or transfer without following this procedure will be deemed invalid. We reserve the right to assign or transfer these Terms or the Agreement at our discretion by notifying you accordingly. These Terms and Agreement will then be binding upon both you and us.

  20 Governing Law and Jurisdiction

20.1 These Terms and the entire Agreement are governed by and interpreted in accordance with the laws of The Netherlands. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If you are a consumer residing in the EEA, this choice of law does not affect your rights under the mandatory legal provisions of the country in which you reside.

20.2 Any dispute or claim arising out of or related to these Terms or the Agreement shall fall under the exclusive jurisdiction of the Dutch courts. However, if you are a consumer residing in the EEA, this does not affect your right to bring a claim in the courts of your country of residence. Additionally, please refer to Section 16.2 above regarding the online dispute resolution platform provided by the European Commission.

21 Entire Agreement

This Agreement (including these Terms) represents the complete and exclusive agreement between you and us regarding your use of the Site and any transactions conducted through it. It supersedes all prior and contemporaneous agreements, understandings, and communications, whether written or oral, between you and us.

22 Updates and Amendments to this Agreement

22.1 In accordance with applicable laws, Klas Amsterdam reserves the right to modify this Agreement at any time without your prior consent. We will notify our customers of any changes made to the Agreement. By continuing to use the Site, you acknowledge and accept the updated terms. It is your responsibility to regularly review the Site for any updates or modifications to this Agreement.

22.2 Klas Amsterdam may also introduce additional terms, conditions, rules, or requirements relating to the Site or any services provided. At its discretion, Klas Amsterdam may offer other services subject to separate terms and conditions.

22.3 The terms in effect at the time of your use of the Site or purchase of products shall govern, regardless of any prior agreements you may have entered into with us under different terms.

23 Mobile Terms of Service

The Klas Amsterdam mobile messaging service (the “Service”) is operated by Klas Amsterdan (“Klas Amsterdam,” “we,” or “us”). By using the Service, you agree to these terms and conditions (“Mobile Terms”). We may modify or discontinue the Service or any of its features at any time without notice. To the extent permitted by law, we may also update these Mobile Terms, and your continued use of the Service after the changes take effect will signify your acceptance of those changes.

By opting into Klas Amsterdam’s SMS/text messaging service, you agree to receive recurring SMS/text messages from Klas Amsterdam at the mobile number you provided, even if that number is on a Do Not Call list. Text messages may be sent using an automatic dialing system or similar technology. Service-related messages may include updates, alerts, and information such as order updates and account notifications. Promotional messages may include special offers, promotions, and marketing materials like cart reminders.

You understand that enrolling in this program is not required to make any purchases, and your consent is not a condition for purchasing goods or services from Klas Amsterdam. Participation in this program is entirely voluntary.

While we do not charge for the Service, you are responsible for all fees and charges from your wireless provider related to text messaging. Message frequency may vary, and standard message and data rates may apply. Please check with your mobile provider for details about your plan. You are responsible for any charges associated with receiving SMS/text messages, including those from your wireless provider.

You can opt out of the Service at any time. To cancel, text the keyword “STOP” to Klas Amsterdam or click the unsubscribe link provided in any text message. You will receive a confirmation text that you have successfully unsubscribed, and no further messages will be sent unless you re-enroll. If you are subscribed to other Klas Amsterdam mobile message services, you must opt out separately from those services by following the instructions provided in their respective Mobile Terms.

We may change the short code or telephone number used to operate the Service at any time, and will notify you accordingly. Please be aware that any messages sent to a changed short code or phone number, including STOP or HELP requests, may not be received, and we will not be responsible for any unprocessed requests.

The wireless carriers supported by the Service are not liable for any delays or failure to deliver messages. You agree to provide a valid mobile number, and if you change your mobile number, you must re-enroll in the program using your new number.

To the extent permitted by law, we are not responsible for failed, delayed, or misdirected messages, errors in such messages, or any actions you may or may not take based on the information or Service.
